These terms are the agreement between you and TechBobcat, doing business as TechBobcat ("TechBobcat", "we", "us"), for the website at https://www.techbobcat.com and every order you place through it. By creating an account, placing an order, or using the site, you agree to them. If you don't agree, please don't use the site.
You must be at least 16 years old to create an account.
To place an order you must be old enough to make a binding purchase where you live. That is the age of majority: 18 in most of Canada, and 19 in British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, the Northwest Territories, Nunavut and Yukon. If you are younger, a parent or guardian must place the order for you.
Security and research products (see section 8) can only be bought by adults who are at least 18.
You agree to give us accurate information and to keep your account details up to date. You are responsible for what happens under your account, so keep your password private. Tell us right away at techbobcat.help@gmail.com if you think someone else is using it.
We sell new, open-box and refurbished technology. Each listing says which one it is, and refurbished items show a condition grade. Our grades are explained on the condition grading page.
We try to describe every product accurately. Photos show the item as listed, and colours can look different on different screens. If a listing is wrong, tell us and we will fix it.
Product names and brands belong to their owners. We use them only to describe what we sell. We are not affiliated with, endorsed by, or sponsored by any manufacturer unless a listing says so.
Prices are in Canadian dollars. The shipping charge and any taxes that apply are shown before you pay.
Payment is handled by Stripe on its own secure page. We never see or store your full card number. By paying you confirm you are allowed to use that payment method.
If a price or stock level is wrong because of an error, we may cancel the order and refund you in full.
When you place an order, we hold the items for a short time while you pay. An order is confirmed when your payment succeeds, and we send you an email.
We can refuse or cancel an order, for example if an item is out of stock, if we suspect fraud, if the order breaks these terms, or if we can't ship to your address. If we cancel a paid order, we refund you in full.
Shipping details are on the shipping page. Delivery dates are estimates. Please check your address carefully. We can't be responsible for a parcel sent to the address you gave us.
Our returns and refunds and warranty pages are part of these terms. Nothing in them limits the rights you have under consumer protection laws that can't be waived.
You agree not to:
If you find a security problem on the site, please tell us at techbobcat.help@gmail.com. Report it to us first, give us a reasonable time to fix it, and don't access other people's data while looking.
Some items we sell are made for learning, research and authorized security testing. They can also be misused. Our acceptable use and security products policy sets out what you may and may not do with them. By buying one of these items you confirm that:
We may ask you questions about an order, delay it, refuse it, or cancel it and refund you. We may also share information with the authorities where the law allows or requires it.
The site, our logo, the design, and the text and images we create belong to us or to the people who license them to us. You may view and print pages for your own personal use. You may not copy, sell or reuse them without our written permission. To report content you believe infringes your rights, see our copyright and trademark complaints page.
We rely on other companies to run the store, including Stripe for payments, and others for hosting, email and sign-in. The privacy policy lists them. They have their own terms and privacy policies. The site may link to other websites. We don't control them and aren't responsible for them.
We work to keep the site available and accurate, but we can't promise it will always be free of errors or interruptions. The site is provided "as is" to the extent the law allows. Nothing here removes a warranty or condition that the law says can't be removed.
To the fullest extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost data, and our total liability for any claim connected to an order is limited to the amount you paid for that order. This does not limit our liability for things the law doesn't allow us to limit, such as death or personal injury caused by our negligence, fraud, or your non-waivable consumer rights.
You are responsible for how you use what you buy. You agree to cover our reasonable losses, including legal costs, if a claim is made against us because you used a product unlawfully or broke these terms.
You can close your account at any time by contacting us. We may suspend or close an account, or refuse service, if you break these terms or the law, or if we reasonably suspect fraud or abuse. Sections that by their nature should continue after that will continue.
We may update these terms. The version that applied when you placed an order governs that order. For other use of the site, the version shown here on the day you use it applies. When we make an important change, we will show the new date at the top and, where we can, tell account holders.
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Courts in Ontario have jurisdiction, except that if you are a consumer you may also bring a claim in the courts where you live when the law gives you that right.
If you live in Quebec: the parties have expressly required that these terms and all related documents be written in English. Les parties ont expressément exigé que les présentes conditions et tous les documents connexes soient rédigés en anglais.
If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given it up. You may not transfer your rights under these terms to someone else. These terms, together with the pages they refer to, are the whole agreement between us about the site and your orders.
